FLYX CLOUD (“us”, “we”, or “our”) operates the Flyx.Cloud website (the “Service”). FLYX CLOUD mean LVLP SRL, a company organized and existing under the laws of Belgium having its office at 19 avenue des volontaires 1160 Auderghem, and registered in the Crossroads Bank for Enterprises under number 0834. 112.403. 

This page informs you of our policies regarding the collection, use and disclosure of Personal Information when you use our Service. 

We will not use or share your information with anyone except as described in this Privacy Policy. 

We use some Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

Processing activities

"Customer" 

is a party who has entered into an agreement for (i) the set-up of one or more FLYX Solutions and (ii) agreed to the terms of use of the selected FLYX Solutions. The FLYX Solutions comprise of the FLYX Click&Collect, FLYX Delivery Solution, FLYX Loyalty, FLYX Kiosk, FLYX OMS, FLYX Product Configurator, and other future solutions which can be used as an integration in the customer’s PoS (using a Connector) and/or the FLYX Staff Display, or FLYX MyStore Solution, which will serve as a user interface for the selected services. 

"End-client "

the person who purchases the customer’s products or services, directly through the customer’s or third-party services. 

Activities of flyx.cloud  

Activities performed on behalf of our customers

FLYX Solutions: refers to one or more of the following FLYX applications and other applications that may be developed in the course of the Agreement.  

FLYX Click&Collect Solution:  a web or mobile application that allows the End-clients to consult Customer’s products catalogue, to select and add items in their basket to perform payment and to arrange for the pick-up of the purchased items.   

FLYX Delivery Aggregator: application software that aggregates information retrieved from and transmitted to the selected Delivery Platforms in a single interface.  

FLYX Kiosk Solution: an application that allows the End-client, present at the Location, to consult Customer’s products catalogue through interfaces such as a touchscreen, to select and add items in their basket and to perform payment through a payment terminal at the Location and to print the receipt after payment.    

FLYX Order Management Solution: a middleware solution that connects to the Customer’s PoS using the Connector and maps the product tree and centralises all order management functions (including product configurator) for various sales channels.   

FLYX Loyalty Solution: a solution that interoperates with the Customer’s vendor system and manages a loyalty program, allowing Customer to keep track of its End-clients’ purchases and awarding rewards to End-customers in accordance with the rules defined by the Client.  

FLYX Staff Display:  a web interface accessible through commonly used browsers and hardware devices which the Customer can use to access and use the FLYX Click&Collect Solution, the FLYX Delivery Aggregator, the FLYX Kiosk Solution and possibly other future FLYX solutions.

CRM :

  • Data collected: company, email, lastname 
  • Legal basis : contractual  
  • Data retention : duration of the relationship unless you want to be deleted sooner. 

For processing activities handled on behalf of our customers, Flyx.cloud acts a Processor in the meaning of GDPR. 

Processing activity for clients 

  • Loyalty Program: when end users want to benefit from a loyalty program, they need to create an account.  
    • Collected end-user data: mandatory:  
      • Depending on your login method: 
        • Facebook connect: token, first name, last name, public profile 
        • Google connect: token, first name, last name, public profile 
        • Apple sign-in : token, first name, last name, optional: email address
        • Manual input: first name, last name, email address
      • For all connection methods: password, user preferences (opt ins), IP address, Device type 
      • Optional collected data (in your ‘advanced profile’). Depending on the customer (brand)’s choice, those data may include your postal code, date of birth, home delivery address, etc.
    •  Legal basis: performance of a contract, legitimate interest for IP (for security reasons) 
    • Data retention: duration of the contract, plus any specific duration set by the Customer   
  • Ordering process: when end users have created an account, they have the possibility to order from different channels (app, kiosks, web interfaces, etc.)  
    • Collected end-user data: mandatory: ordered goods, store location, payment method. 
    • Legal basis: performance of a contract 
    • Data retention period: duration specified by the Customer 
  • Home delivery: when end users wish to receive orders at home:  
    • Collected end-user data: mandatory: delivery address, delivery instructions, phone number (if you provide your consent to keep this number in phone cache memory) 
    • Legal basis: performance of a contract (the order) 
    • Data retention: duration specified by the Customer 

Other data may be collected in the framework of custom developments ordered by the customer, as Data Controller, under legal basis of the contract performance. Those custom developments are not part of the standard Flyx.cloud (Processor) products and offering. Details regarding collected end-user data, retention periods, etc. can be found in the Customer privacy policy. 

Log Data

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used. 

These third parties may have access to your Personal Information only to perform these tasks on our behalf and are bound to comply with data protection laws by contract. They may not disclose or use it for any other purpose. 

Service Providers

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Security

The security of your Personal Information is important to us. We are implementing appropriate technical and organizational measures at all levels according to GDPR, to ensure the confidentiality, integrity and availability of information systems and services that process personal data. These measures include physical and operational security measures, physical and system access controls, confidentiality clauses in our contracts and ongoing training for our staff. 

Our employees and third parties engaged by us are required to respect the confidentiality and security of your data. A higher or equivalent level of protection is required from our sub-processors.  

Transfers outside the EEA 

In order to perform high quality services, we  In the case of delivery services, our Customers may choose to entrust certain operations to Processors, acting upon instructions. Therefore, your data is safely transferred to those Processors who will serve you in your country. 

In cases where your data is transferred to a country outside the European Economic Area ("EEA"), transfers are done with the utmost care. If the country does not offer a level of data protection corresponding to that of the EU, Customers are responsible for systematically adding appropriate technical and organizational requirements to their Data Protection Agreements in order to guarantee an equivalent level, in particular via the legal mechanism of the European Commission's Standard Contractual Clauses.
